The Hershey Company is celebrating the Halloween scene like never before this year, after a sweet victory in court.
Hershey brings 20 different choices to Halloween fans this year in single and trick ‘or treat-sized bags, including Cookies ‘N’ Creme Fangs, Kit Kat Count & Witch bars, and the controversial Reese’s Peanut Butter Pumpkins.
Last August, Hershey won a class action lawsuit claiming that Reese’s jack-o-lantern wrappers didn’t match the non-decorated chocolate and peanut butter pumpkin shapes.
U.S. District Judge Melissa Damian ruled that the difference between the artwork on the wrappers and the actual product did not constitute “a concrete economic injury” and would “all boil down to their subjective, personal expectations of how the products would or should have looked when unpackaged”.
Katie DeCapria, senior brand manager for Halloween at Hershey, said “We know what consumers love. We have not made any changes to the Reese’s shapes. The pumpkin is the cornerstone of our portfolio”.
